A pair of First Nations in BC are set to appeal a provincial Supreme Court Ruling made last month in relation to the Nechako River.
That ruling found that the Kenney Dam’s decades of operation have caused significant damage to the Nechako River, and its ecosystems.
But, the Court also ruled that the Dam’s operator, Rio Tinto Alcan, has complied with and continues to abide by the terms laid out in its license.
Because of that, the court rejected the Stellat’en and Saik’uz First Nations’ ask for an injunction to restore the natural flow of the river.
Now, the Nations say they are planning a limited appeal to the ruling.
They hope the Court will order the restoration of water flows which would support the fish populations of the river, which includes declining populations of Sockeye salmon, and Nechako white sturgeon.
