RCMP Commissioner Brenda Lucki has violated her legal obligations, according to the Federal Courts.
A ruling which came down today found Lucki took too long to investigate claims of police misconduct, violating her mandate.
When the Civilian Review and Complaints Division disagree with how the RCMP handle civilian complaints, they prepare an interim report.
That report then goes to the Commissioner for review, and only once they respond, can investigators release their findings.
But from Lucki, that response has often taken far longer than expected, sometimes months or even years.
According to the Courts, this undermines the CRCC’s ability to provide proper and adequate oversight.
A Federal Court case looking in to the matter was initially launched in 2014, following reports of RCMP spying on Indigenous and environmental land defenders.
In their response, the Federal government says the force is improving, and the requirement to have her respond “as soon as feasible” should be more flexible.
