Conservative Leader Pierre Poilievre and MP Chak Au are urging the federal government to intervene in the Cowichan Tribes v. Canada case, warning that a recent B.C. Supreme Court ruling threatens property rights and economic stability.
In a letter sent to Justice Minister Sean Fraser on September 28, the two MPs argue that the August 7 ruling, which challenges fee simple land ownership in a long-standing title dispute, creates significant uncertainty for homeowners and businesses.
Poilievre pointed to growing concern among funders and investors, warning that the ruling could undermine confidence in Canada’s real estate system and deter investment.
Several parties—including the B.C. government, City of Richmond, Vancouver Port Authority, Tsawwassen First Nation, and Musqueam Indian Band—have already filed appeals.
The Conservatives are calling on the federal government to take a clear position and argue against the ruling in court, saying it threatens the rights of all Canadians.
The letter criticizes conflicting government statements on the impact of the ruling, noting that some officials downplay the risk while others acknowledge the threat to mortgage access and economic certainty.
