As of today, Residential School day scholars can begin submitting claims to receive compensation thanks to a legal settlement.
This day scholars’ settlement was agreed upon back in October of 2021 and its creation was necessary due to these survivors, that were able to go home after the school day was done, being left out of the 2006 Indian Residential Schools Settlement agreement.
These survivors were also not deemed eligible to get that previously mentioned settlement’s common experience payment, which would have seen those survivors get $10,000 for the first year of living at a residential school, and $3,000 for every other year they lived at one of those schools.
This settlement’s creation is also thanks to a class action lawsuit that was filed back in 2012 by the shíshálh nation and the Tk’emlúps te Secwe̓pemc nation.
Ever since this claims process was opened, over 60 members of the shíshálh alone have begun applying for this compensation.
As for the requirements to apply, anyone who made it onto the settlement’s list and did not stay at their school overnight is able to seek out compensation.
